The meeting was called to order by Chairman Muhs with all Commissioners and Road Superintendent Hebl present.

Additions to the agenda were; signing the contract and contract bond for county paving projects, Mr. Donald Meyer regarding township road to his place and Discussion of Sheriffs Deputies salaries.

The agenda was approved by a motion made by Commissioner Heidinger seconded by Commissioner Flath with all voting “yes”.

The minutes of the May meetings were approved by Commissioner Aberle seconded by Commissioner Heidinger with all Commissioners voting “yes”.

The welfare expenditures for the month of May were approved by a motion made by Commissioner Heidinger seconded by Commissioner Klein with all voting “yes”.

Road Superintendent Hebl informed the Board that he has ordered two rail cars of magnesium chloride for the dust control program and when they arrive, they will start incorporating the chemical if the weather permits.

Hebl reported that the on going rain has been a problem.  Projects are a little behind due to the delays.  They are graveling in townships and have three miles of shoulders left to pull.  Hebl stated that they pulled one and one half miles of shoulders last week.  Crews are fixing culverts and doing repairs to damaged roads for the townships.  Hebl stated that the excess rains are beginning to show as slews are filling up and roads are going under water.  Hebl stated that the road department will take care of emergency work for the townships.  Barricades have been placed on inundated roads in the townships.  Hebl stated that there are no serious problems on county roads.

A blanket permit for forty eight different crossing of county roads was granted to Dickey Rural Services by a motion made by Mr. Klein seconded by Mr. Flath with all voting “yes”.

Road Superintendent Hebl reported on the asphalt reclaiming project that has been completed in Barnes County.  The contractor reclaimed about two and one half miles of road each day.  He stated that it looked good and the cost was around $80,000.00 per mile.  The project still needs to be chip sealed.  Hebl stated that a reclamation project like that might not work so well in the county due to the fact that the county roads only have about a two inch base to them.

Mr. and Mrs. Donald Meyer met with the board to discuss the township road that runs by their farmstead.  The road to the east of their farm is presently under water again.  They stated that they have talked with the township people about the situation and said the township will not do any thing about the problem.  They did state that the township has had gravel placed on and graded the section of road that continues on to the west of their farm but they didn’t think the road was in the best driving condition.  The Meyers were informed that the Commissioners can not order work to be performed on the road due to the fact that it is a township road.  The township budget was also reviewed with the Meyer’s 

Hebl asked the Board to consider issuing an emergency declaration due to the excessive rains.  Following discussion, Commissioner Heidinger offered the following resolution and made the motion to adopt said resolution;

EMERGENCY DECLARATION OF 2007

WHEREAS, LaMoure County citizens have suffered damage to their property caused by heavy downpours of rain, throughout the County of LaMoure, occurring during the month of May and continuing.  The rains, accompanied by high winds, have caused saturated lands, ravine and overland flooding, isolating rural residents, and damaging homes and infrastructure.  These storms, often following pathways similar to previous systems, have caused culvert washouts and road damages, jeopardizing fire, police and ambulance support.

WHEREAS,  storm conditions have caused damages to transportation infrastructure, private property, and are preventing the seeding of crops, the timely weed control of previously planted crops and endangering economic interests.  Potential agricultural damages and expenditures of damage control and repair, as well as private and other business losses, will constitute a serious economic hardship through out the entire County of LaMoure.

WHEREAS,  the cost of response cleanup, repair and replacement of such damaged property is far in excess of available citizens resources.

NOW, THEREFORE BE IT RESOLVED, that the Board of County Commissioners declare an emergency and orders the activation and utilization of the LaMoure County Emergency Operations Plan, its procedures, attachments and appendices to monitor the situation, alleviate hardship and initiate appropriate relief actions and mitigation measures by departments and agencies of local government to limit the hardships and impact of this emergency upon the citizens of LaMoure County.

LaMoure County Treasurer Kathy Exner met with the Board and asked that the taxes on the following parcels be canceled;

The taxes are being canceled due to the properties, either, being sold at the annual tax sale or at a private sale of tax forfeited properties, on which the assessed values were not removed because the county taxable valuation has to be set in September and the properties are not fore closed on until October 1st.  Commissioner Flath made the motion to cancel the taxes on the properties.  The motion was seconded by Commissioner Aberle and passed with all voting “yes”.

  Mrs. Exner also requested that she be allowed to attend an ILG class that will air over the interactive video conference equipment located in the Court House.  The Board had no objections to her request.

9:00 a.m.   Mr. Al Berg, Prairie Rose Benefits, met with the board and relayed information regarding the counties health care provider and the increase in premiums that will be in place for the next two years.  Mr. Berg also gave a presentation on the various products his company sells.

The 2007 LaMoure County Tax Equalization meeting was called to order by Chairman Muhs with all Commissioners and County Tax Director Ralph Evert present.  Mr. Evert presented the land values on crop and non crop lands prepared by the State Tax Department.  Evert stated that the County has to set the value with in (+ or –) 5 percent of the value set by the State, or the State will set the value of the agricultural lands, residential and commercial properties at 100 percent of the value determined by the State Tax Department.  Mr. Evert stated that the Board needed to increase the value of agricultural and non crop land at least 1.3 percent to fall with in State tolerances and increase the value of residential properties a least 2 percent.  Evert stated that the commercial properties in the County fall with in State tolerances and do not need to be changed.  Following some discussion Commissioner Aberle made the motion to increase the value of agricultural and non crop lands one and three tenths percent, increase residential properties two percent and make no changes to the commercial properties located with in the County.  The motion was seconded by Commissioner Heidinger and passed with all Commissioners voting “yes”.

The contract and contract bond for the county overlay projects, scheduled for 2007, were authorized to be signed by the Chairman.

The ADA side walk project was discussed.  Mr. Klein stated that he wants to make sure that it is completed this year.

Sheriffs Deputies Donald Schumacher and Jeff Fleck met with the Board regarding the increase in salary that was granted them in January.  They asked that the increase not be taken away because they still have to carry a larger work load due to the fact that the Sheriff and third deputy haven’t the experience that they have.  Officer Fleck also made statements regarding being called to respond when he was supposedly off duty.  Deputy Fleck questioned some of the Board members, regarding times when he responded to situations while he was off duty, as to weather he was on duty or not.  The officers were informed that the salary adjustment would be reviewed at the next meeting.

The LaMoure County Tax Equalization Meeting was closed at this time.  No citizens attended the meeting to discuss the taxable valuations of their properties.

The vacant County Disaster Emergency Directors position was discussed.  The position will be advertised as a part time position, with applications being taken up to the 29th day of June.

Mr. Dale Horn representing the Jamestown Community Corrections Program updated the Board regarding law changes and funding for the program.

The prisoner board agreement with Burleigh County was approved by a motion made by Commissioner Flath seconded by Commissioner Aberle with all voting “yes”.

Meeting dates were set for June 19th, July 5th, 16th and August 7th.  The Board will attend the five county meeting on July 12th.

County Recorder Donnell Morrison informed the Board that she had $850.00 in her budget to be used to recover record books in her office.  She stated that that is enough money to recover twelve books this year. 

The letter of resignation from the position of LaMoure County Disaster Emergency Service Director, submitted by Mr. Rick Ballinger was accepted by a motion made by Commissioner Heidinger seconded by Commissioner Flath with all voting “yes”.

JUNE 19, 2007

The meeting was called to order by Chairman Muhs with all Commissioners and Road Superintendent Hebl present. 

Additions to the agenda were; Sheriff Fernandes regarding deputy and secretary salaries, transfer of funds to the Social Welfare fund, and remove the Mida Bond Resolution from the agenda.  The agenda was approved by a motion made by Commissioner Heidinger seconded by Commissioner Klein with all voting “yes”.

Road Superintendent Hebl reported that water was over County road 65 in three places, but did recede quickly.  Hebl stated that he feels there is more water now than in 1997

Hebl stated that he and Mr. Ross Eberle have looked at the bridge on County road 61 (the golf course road) south of LaMoure and he stated that he hopes it can be replaced this year.  He said that Cotton Wood Creek has to stop flowing before the work can be started.

The Magnesium Chloride, for the dust control program, isn’t in yet.  Hebl hopes that it will arrive next week and that the weather cooperates so they can complete the process next week.  Hebl stated that there are a total of fifty five sites to do which is about five more than last year.

Hebl informed that Board that there are three state auctions coming up and that he intends to attend them in hopes of purchasing some equipment.  He is looking for a power broom, snow plows, a tandem truck and two pickups.  He hopes to purchase the items if the price is right.  Hebl reported that the crusher was down for a week and one half due to the main cord, which supplies the power to run the plant, being damaged.  Hebl stated that he thinks it was hit by lightning, which also burned out a couple of electric motors and the digital scale on the stacking conveyor. 

The crusher is in the Meiklejohn pit and it is scheduled to be moved to the Seefeldt pit next week.  Hebl stated that in a normal year they would be done with the chip seals by now and would be crushing gravel again.  Trucks have been hauling gravel and Hebl stated that there is quite a bit of graveling left to do.

            The summer crew are crack sealing and have about a week left to do on County road 35. They have completed crack sealing on County roads 61 and 163.

County forces have been working on storm related projects for the townships, mainly doing emergency repairs to their roads.

Hebl informed the Board that he hasn’t been informed as to when the contractor will start on the County projects.  He also reported on the asphalt reclaiming project in Barnes County.  He stated that it looked real good and the cost was around $80,000.00 per mile.  Hebl also said that he didn’t think the process would work real well in LaMoure County due to the fact that the county roads do not have enough base material on them.

Commissioner Aberle reported on the meeting that he and Chairman Muhs attended in Dickey County on June 18, 2007.  Discussion was held on the possibility of sharing a Disaster Emergency Management Officer.  Mr. Aberle stated that the Dickey County Board was receptive to the idea but Dickey Counties Emergency Manager wasn’t real enthused with the idea.  The DES Officer felt it would work if various plans could be used for both counties, but he suggested, that four counties go together, have a full time officer in each county and that he  be in charge of the four.  Applications, for the position, will be reviewed at the July 3rd meeting.

Commissioner Muhs reported on the meeting, with department heads, he and Commissioner Flath attended.

Mr. Mark Spitzer, technical director for the Memorial Park Summer Theater, met with the Board and reported on various items of disrepair to the auditorium.  The items were; the foundation, stage, roof, lights, sound curtains and insulation located in ceiling of the auditorium.

Sheriff Fernandes met with the Board to discuss the increase in salary that was given to the deputies and office secretary.  He asked that the Board consider giving them at least one half of the amount that was granted in January.  Sheriff Fernandes stated that he felt the deputies deserve and have earned the increase.  County States Attorney Kimberly Radermacher stated that the case numbers have increased over the previous year.  The request was discussed following which Commissioner Aberle made the motion to grant an increase in salary of $125.00 per month to office secretary Hamlin and a $250.00 increase per month to deputies Schumacher and Fleck, on the 2007 budget approved salaries, for July through December, 2007.  Commissioner Flath seconded the motion.  During discussion on the motion, Commissioner Heidinger stated that he felt the office secretary’s salary should go back to the amount originally budgeted for 2007.  Following additional discussion Commissioner Heidinger made the motion, to amend the original motion made by Commissioner Aberle.  Commissioner Heidinger amended the motion to be as folows; to grant an increase of $250.00 per month to the original 2007 budgeted salaries of Sheriff Deputies Schumacher and Fleck effective July 1st and that the salary of the office secretary returned to the original amount as set for the 2007 budget year beginning July 1, 2007.  The amendment to the motion was seconded by Commissioner Aberle and passed with Commissioners Heidinger, Flath, Aberle and Muhs voting “yes” and Commissioner Klein voting “no”.

The original motion passed as amended with the following roll call vote; Commissioners Heidinger, Flath, Aberle and Muhs voting “yes” and Commissioner Klein voting “no”.

Sheriff Fernandes informed that Board that the new Sheriff’s vehicle would be picked up this afternoon and is ready for service.

$240,000.00 was authorized to be transferred from the County Human Service fund to the County Social Welfare fund by a motion made by Commissioner Aberle seconded by Commissioner Flath with all Commissioners voting “yes”.

County States Attorney Radermacher informed the Board that she has been requested to get all of the counties civil and criminal files from the office of Kessel, Splitt and Mahler by July 15th.

AUGUST 7, 2007

 

8:30 A.M.       The meeting was called to order by Chairman Muhs with all Commissioners and Road Superintendent Hebl present.

 

The agenda was approved by a motion made by Commissioner Heidinger seconded by Commissioner Aberle with all voting “yes”.

 

The minutes of the July meetings were approved by a motion made by Commissioner Aberle seconded by Commissioner Klein with all voting “yes”.

 

Road Superintendent Hebl informed the Board that the contractor for the Counties overlay project was moving his equipment to the pit location.  He stated that they will start the patching work first.

 

A letter received from the US Postal Service ask the Board if a township road located in Gladstone Township would receive a grade raise so the road could be opened to traffic.  Hebl stated that FEMA doesn’t approve grade raises if there is an alternate route that can be used.

Hebl stated that they have completed doing the addition to the base on the road by Lake LaMoure that is to be paved this year.  Rocks are being hauled to the hot plant site for the county overlay project.  A loader has been moved to the Meyer pit and the crew will be graveling township roads in the western part of the county.

 

Two inspectors with FEMA are in the county and will be inspecting damage sites from the June storm.  There will be a kick off meeting on Thursday morning be fore the inspectors can start the process of estimating repairs needed for the damage areas.  Hebl explained the procedure that has to be followed for the record keeping of the repair for each site.

 

Boring permits were approved for 37 crossings for Dickey Rural Services by a motion made by Commissioner Klein seconded by Commissioner Aberle with all voting “yes”.

 

Welfare expenditures for the month of July were approved by a motion made by Commissioner Heidinger seconded by Commissioner Aberle with all voting “yes”.

The Bond Issuance Resolution for the LaMoure County, North Dakota Municipal Industrial Development Act Revenue Bond (Cares-Community Action Region Six Project) Series 2007 was approved and the Chairman and Auditor were authorized to sign the same be a motion made by Commissioner Aberle seconded by Commissioner Klein.  Said motion passed with the following vote; Voting “Aye” Commissioner Keith Heidinger, Commissioner Robert Flath, Commissioner Bruce Klein, Commissioner Richard Aberle and Commissioner Robert Muhs.  There were no “Nay” voters cast and no Commissioners were absent and not voting.  Following the vote Chairman Muhs declared that the motion passed.

 

County Tax Director Ralph Evert presented copies of a letter from the State Tax Commissioner explaining the new law (HB1303) that has to do with appraisal of agriculture lands.  Evert stated that the he believes the county complies with the new law and he hopes the State will see it that way also.

 

County Director of Emergency Services Sheri Gartner met with the Board to inform them of the work that she has completed so far and a listing of items that still need to be completed.  Ms. Gartner updated the Board regarding 2005 and 2006 Home Land Security Grant monies.  She stated that the 2005 money has to be spent and paper work completed by September 30, 2007 and the 2006 money has to be used and paper work completed by February 28, 2008.

 

Ms. Gartner told the Board that she didn’t think she could complete all the projects that need to be completed by the dead lines set if she only worked 21 hours per week. 

 

The title of her position was discussed and all agreed that it should be Director of Emergency Services.

 

Moving her office to the road shop will be checked into.

 

Ms. Gartner informed the Board that the repeater at Verona hasn’t been working for a while and the one located on the tower located in Larry Harmsens’ pasture that is used by the LaMoure Community Ambulance Service and LaMoure Fire Department has needed maintenance lately and company that did the maintenance said that parts are no longer available for the repeater.  The two repeaters will be replaced and the E-911 fund will be used to pay for the radios.

 

Ms. Gartner also asked that she be allowed to purchase a new hand held radio for her office.  One half of the cost would be paid by the state department of emergency services.

 

Gartner asked if she could replace the hand held radio.  It is an analog radio and its uses are limited.  The DES budget has $1,500.00 listed for radios and the radio that will work well for her office is around $2,500.00.  Gartner will check with the state office to see if money designated for other expenditures could be used.

 

After Gartner left the meeting the Board discussed changing the position from a three fifths time to full time.  Following considerable discussion Commissioner Aberle made the motion to offer Ms. Gartner a full time position until December 31, 2007 at which time the status of the position will be reviewed and said position to be at paid at an annual salary of $25,000.00.  The motion was seconded by Commissioner Klein.  Following more discussion the motion passed with Commissioners Klein, Aberle and Muhs voting “yes” and Commissioners Heidinger and Flath voting “no”.

 

Commissioner Muhs told the rest of the Board that he had been contacted by Mr. Ralph Greer, from Marion, and asked if the Marion Cafe could serve the meals, that, at the present time, are provided by South Central Adult Services from the LaMoure kitchen.  Commissioner Klein stated that having cafe’s supply the meals has been discussed and that South Central stated that it wasn’t feasible.

AUGUST 21, 2007

 

8:30 a.m.        The meeting was called to order by Chairman Muhs with all Commissioners present.  Also present was Road Superintendent Hebl

 

Additions to the agenda were an application for a raffle permit and Tax Director Ralph Evert.

The agenda was approved by a motion made by Commissioner Aberle seconded by Commissioner Heidinger with all voting “yes”.

 

Hebl reported on the County overlay project.  He said that there was one mile of Co. Rd. 66 left to do.  The contractor stopped on the Counties project and has been doing a project in Lisbon and will do the project at Lake LaMoure before returning to the county project.

 

Hebl reported that the county crew has been doing some patching work with hot mix.  They have worked on Co. Rd’s. 34 and 62 and have a few areas left to do on Co. Rd. 35.

 

A county crew is working on Co. Rd. 63 and placing clay to reinforce the base of the road.  Two miles of the road has had gravel and recycled asphalt placed.  Hebl said that the road is turning out real nice.

 

Hebl reported that he hasn’t been having any luck purchasing vehicles.  He has been to several sate auctions but the vehicles he has been interested in have sold for more than he felt they were worth.  There are a few more auctions listed for this fall.

 

Hebl reminded the Board that the State Department of Transportation has scheduled 10:40 a.m. on October 9 during the Association of Counties Convention to meet with them to discuss future road projects and the anticipated allocation of Federal High Way monies.

 

Hebl stated that there probable wouldn’t be a project in 2008 as there is one bond payment left.

 

The fall road advisors conference is scheduled for October 16th, 17th and 18th at Rapid City South Dakota.  He stated that there is still room on the buss if any one wanted to go.

 

The box culvert that will be used to replace the bridge on County Road 61 on the Cotton Wood Creek has been ordered.  The company will keep it in their inventory until it is ready to be placed.

 

An easement for Dickey Rural Communications to bury a line along the south side of Memorial Park was approved by a motion made by Commissioner Heidinger seconded by Commissioner Klein with all voting “yes”.

 

A report on the Community Corrections Program for 2006 was reviewed.  It was reported that four hundred and three hours of community service has been completed in 2006 at twelve work sites saving around $2,423.40 in wages and about 50 days of jail time.  There are twenty eight worksites in the county available at this time.

 

The agreement for offering financial support for operating the Community Service program in the County was reviewed.  The quarterly fee will be checked to make sure it is right.  Following review, Commissioner Klein made the motion to sign the agreement with Jamestown Community Correction Program.  The motion was seconded by Commissioner Aberle and passed with all voting “yes”.

 

A hold harmless agreement with James Valley Grain Elevator of Verona for the placement of a radio repeater and antenna at the elevator was reviewed by the Board.  Following review Commissioner Heidinger made the motion to authorize the Chairman and Auditor to sign the agreement.  The motion was seconded by Commissioner Flath and passed with all voting “yes”. 

 

Commissioner Flath reported on the task force meeting held on August 16th.  The meeting was held to decide what equipment should be purchased with the remainder of the 2005 and 2006 home land security grant monies.

 

Tax Director Ralph Evert met with the Board to discuss the placing of carpet in the basement hall way of the court house.  Evert also informed the Board about tax exemptions that are available for business and the new law regarding tax exemptions for disabled veterans.  The Board asked to see if the county can allow a percentage of the exemption.

 

Mr. Evert was asked about the counties agriculture land valuations and soil maps and if the County was in compliance with the new law regarding the valuation of agricultural land.  Evert stated that new soils maps will cost around $50,000.00 but he felt that the County may not have to do too much to be in compliance.

 

County Recorder Donnell Walstead met with the Board to discuss several topics.  She asked to be allowed to attend the Association of Counties convention in October and was approved.  Reported that the HP Printer in her office quit and she ordered a replacement at a cost of $353.00. 

Walstead reported on the national recorders convention that she attended this summer.  She was the state delegate so her expenses were paid by the association.  Walstead also informed the Board that the Counties web site has been updated, reported on the progress that has been made on scanning the UCC files, and the all burial permits and election ballots will be moved to the Recorders Office by January 1, 2008 and stored there.  Walstead told the Board that the new replacement covers that were ordered didn’t fit the books and that the company will be back to re measure the books that the covers were ordered for.  Also discussed was the severing of the hunting rights from land when it is sold.  North Dakota law doesn’t allow the practice yet but there are states that do allow it.

 

Ms. Walstead also informed the Board that she is planning to help the Recorder in Sargent County as she is quite a bit behind.  She stated that her office will function normally.
